1. Definitions

Creochi: the content workflow platform operated by Dag&Dauw, located at Dorpsakkers 1, 6027SJ Soerendonk, The Netherlands, registered with the Dutch Chamber of Commerce (KVK) under number 56188110, hereinafter referred to as "we", "us", or "Creochi".

User: any natural or legal person who uses Creochi, hereinafter referred to as "you" or "user".

Platform: the website creochi.com, the application Creochi Studio, and all related services, tools, and APIs.

Connected Platforms: third-party social media and advertising platforms that you connect to Creochi via OAuth authorization (e.g., Facebook, Instagram, YouTube, LinkedIn, TikTok).

2. Nature of the service

Creochi is a content workflow and analytics platform. We assist creators and marketing teams in planning, producing, analyzing, and publishing content. Creochi provides:

  • Content strategy and planning tools
  • Video production workflow management
  • Performance analytics dashboards
  • Content publishing and scheduling capabilities
  • AI-supported content suggestions under user control

Creochi does not replicate or replace social media platforms. We provide workflow, analytics, and publishing tools that complement your use of Connected Platforms.

3. Applicability

These terms of service apply to all use of the Platform and to all agreements between Creochi and the User. By creating an account or using the Platform, you agree to these terms and our Privacy Policy.

4. Account and registration

  • To use certain features, you must create an account with accurate and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not share or transfer your account to third parties.
  • You must be at least 16 years of age to create an account.
  • You are responsible for all activity that occurs under your account.

5. Content ownership

You retain full ownership of all content you create, upload, or publish through Creochi. We do not claim any intellectual property rights over your content.

By using the Platform, you grant Creochi a limited, non-exclusive, revocable license to store, process, and transmit your content solely for the purpose of providing the service. This license terminates when you delete your content or close your account.

Content you publish to Connected Platforms through Creochi is subject to those platforms' respective terms of service.

6. Connected Platform compliance

Creochi accesses third-party platforms exclusively through their official APIs. We comply with the developer terms and policies of all Connected Platforms, including but not limited to:

By connecting a third-party platform to Creochi, you confirm that you have the authority to authorize access and that your use complies with that platform's terms.

If you use Creochi to upload or publish content to YouTube, you certify that your content complies with the YouTube Terms of Service and the YouTube Community Guidelines.

7. API usage and rate limits

Creochi respects the rate limits, usage quotas, and technical restrictions imposed by each Connected Platform's API. We implement the following practices:

  • All data retrieval occurs through official, authorized API endpoints
  • We implement request throttling and caching to stay within rate limits
  • We monitor API usage and adjust request frequency as required by platform policies
  • When rate limits are reached, requests are queued and retried within permitted intervals

8. Restrictions

When using Creochi, you agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Upload content that infringes on the intellectual property rights of third parties
  • Circumvent or undermine the security of the Platform or Connected Platforms
  • Use the Platform to send spam, unsolicited messages, or bulk automated communications
  • Engage in data scraping, web scraping, or any form of automated data collection outside official APIs
  • Use bots or automated scripts to interact with Connected Platforms outside Creochi's intended functionality
  • Perform mass automation without explicit user initiation for each action
  • Use the Platform for lead scraping, contact harvesting, or growth hacking activities
  • Combine platform data with external data sources for profiling, enrichment, or targeting of individuals
  • Automate direct messages on any Connected Platform — all messaging workflows require human initiation and approval
  • Reverse-engineer, decompile, or attempt to extract source code from the Platform
  • Exceed the usage limits of your subscription plan

9. AI-powered features

Creochi offers AI-supported features (such as content suggestions, subtitle generation, and smart titles) to assist your creative workflow. These features operate under the following principles:

  • AI-generated content is always presented as a suggestion — you have full control to review, edit, accept, or reject any output
  • AI features process only content text that you explicitly submit — we do not automatically feed personal data or platform-sourced data into AI models
  • We do not use your content or platform data to train AI models

10. Intellectual property

All rights to the Platform itself — including software, design, trademarks, logos, and documentation — belong to Creochi (Dag&Dauw). You may not copy, modify, distribute, or create derivative works from the Platform without our written permission.

11. Subscriptions and payment

  • Creochi offers various subscription plans, including a free Starter plan with limited features.
  • Paid subscriptions are billed monthly or annually via Stripe.
  • Prices are exclusive of VAT, unless stated otherwise.
  • You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are not available for already billed periods.
  • We reserve the right to change pricing with 30 days' notice.

12. Availability and support

We aim for 99.9% uptime but do not guarantee uninterrupted availability. The Platform may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for planned maintenance.

13. Liability

  • Creochi is not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.
  • Our total liability is limited to the amount you have paid us in the preceding 12 months.
  • We are not liable for content that users create, upload, or publish through the Platform.
  • We are not liable for actions taken by Connected Platforms, including API changes, access revocations, or policy modifications.
  • We are not responsible for the accuracy of third-party analytics data provided through Connected Platform APIs.

14. Termination

  • You may terminate your account at any time through your account settings or by contacting us.
  • We may suspend or terminate your account if you violate these terms, with notice where feasible.
  • Upon termination, your data will be deleted within 30 days, including all Connected Platform data. See our Privacy Policy for details.
  • Provisions regarding intellectual property, liability, and governing law survive termination.

15. Privacy

We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

16. Changes to these terms

We reserve the right to modify these terms. For material changes, we will notify you at least 30 days in advance via email or through the Platform. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated terms.

17. Governing law and disputes

These terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these terms shall be submitted to the competent court in the Netherlands.
